Terms and conditions

1. Acceptance
These terms govern the use of the Homecaria platform (hereinafter, "the Service"), operated by Homecaria SpA (in formation), domiciled in Santiago, Chile (hereinafter, "Homecaria", "we"). By creating an account, contracting the Service or using it in any way, the user (hereinafter, "the Agency" or "you") fully accepts these terms.
2. What the Service is
Homecaria is a software as a service (SaaS) that allows home care agencies to manage patients, shifts, caregivers, clinical records, communication with families and operational reports. The Service is accessed via web (app.homecaria.com) and, soon, via native mobile applications.
Homecaria is not a medical device, does not replace the clinical judgment of healthcare professionals, and does not diagnose or prescribe treatments. The features assisted by artificial intelligence (voice transcription, reading of written notes) are support tools that require human validation by the caregiver or responsible professional.
3. Accounts and roles
- The Agency is responsible for keeping its users' access credentials (owners, coordinators, caregivers) confidential.
- Each user must have a personal and non-transferable account.
- The Agency is responsible for the actions carried out from accounts associated with it.
- The Agency must immediately notify Homecaria of any unauthorized use of its account.
4. Patient data and consents
The Agency, when uploading patient data to the Service, declares and warrants that:
- It has informed consent from the patient or their representative to process their personal and health data, in accordance with Chile's Ley 19.628 and equivalent regulations (LGPD Brazil, GDPR where applicable).
- It has additional express consent when it enables the patient photographs module (biometric data).
- It will handle the requests for access, rectification, cancellation and objection that data subjects exercise over the data.
- It is the principal party responsible for the processing of clinical data. Homecaria acts as data processor, in accordance with section 1 of our Privacy policy.
5. Acceptable use
The Agency agrees not to use the Service to:
- Store data whose processing is not legitimized by consent or by a valid legal basis.
- Reverse engineer, copy, modify or create derivative works from the Service.
- Interfere with the security or operation of the Service (unauthorized scans, attempts to circumvent limits, DoS attacks).
- Resell or sublicense access to the Service without prior written authorization.
- Any illegal activity or one that infringes the rights of third parties.
6. Artificial intelligence
Some features (transcription of voice dictations, extraction of vital signs, reading of handwritten notes) are assisted by artificial intelligence models. These features:
- Are support tools, they do not replace human verification.
- May contain errors. The caregiver or professional must always review the result before saving clinical records.
- Have a monthly quota configurable per agency. If the quota is exhausted, the AI features are temporarily disabled.
7. Pricing and billing
The price of the Service is billed per active patient per month, according to the plan contracted by the Agency. Current prices are available at homecaria.com and may be modified with at least 30 days' notice. Price modifications take effect in the billing cycle following the notice.
Failure to pay on time entitles Homecaria to suspend access to the Service. Data remains available for export for 30 days from the suspension, after which it may be deleted.
8. Service availability
Homecaria strives to keep the Service available 24/7, but does not guarantee uninterrupted availability while the Service is in beta phase. We may carry out scheduled maintenance, which will be communicated with reasonable advance notice when possible.
9. Intellectual property
The Service, its code, design, brand and documentation are the exclusive property of Homecaria. The Agency obtains a limited, non-exclusive, non-transferable license to use the Service during the term of its contract.
The data uploaded by the Agency (patients, clinical records, photos, notes) are the property of the Agency and of the data subjects. Homecaria only processes them to provide the Service.
10. Confidentiality
Both Homecaria and the Agency undertake to keep confidential the non-public information they access by virtue of the Service. This obligation survives for 5 years after the contract ends.
11. Limitation of liability
To the maximum extent permitted by law, Homecaria's total liability to the Agency for any claim related to the Service is limited to the amount actually paid by the Agency to Homecaria during the 12 months prior to the event that gave rise to the claim.
Homecaria shall not be liable for indirect damages, loss of profit, or loss of data attributable to force majeure or to failures of the subprocessors listed in the Privacy policy.
Important. The Service is a management tool. Clinical decisions, the quality of care, and compliance with labor and health obligations toward patients and caregivers are the exclusive responsibility of the Agency.
12. Termination
- The Agency may close its account at any time from the platform.
- Homecaria may terminate the Service with 30 days' notice by email.
- Homecaria may suspend or terminate the Service without prior notice in the event of a serious breach of these terms, especially fraudulent use, violation of Ley 19.628 or non-payment.
- After termination, the data remains available for export for 30 days and is then deleted irreversibly.
13. Modification of these terms
We may modify these terms to reflect legal or functional changes. Material modifications will be notified by email with at least 15 days' advance notice. Continued use of the Service after the effective date constitutes acceptance of the new conditions.
14. Applicable law and jurisdiction
These terms are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the jurisdiction of the ordinary courts of justice of the city of Santiago, without prejudice to the mandatory consumer protection rules that may be applicable.
